Call Recording & Consent Notice

All legal documents

Your duty

Call-recording laws are not the same in every place. Some states, including Montana, generally require every person on the call to consent before the call is recorded. Other places require only one person to consent. You are responsible for knowing which rule applies to your callers and for complying with it. JKC Strategies, Inc. does not decide that for you.

Disclosure in the greeting

When call recording is on for a business, Optana can say a short disclosure at the start of the greeting, before the conversation. The default text is:

This call is recorded for assurances and training.

You may replace that sentence with your own recording notice in the business settings. A greeting that already tells the caller the call is recorded or transcribed is left as you wrote it. Turning the recordings add-on on is your statement that you have read this notice and that you will use recording only where you may legally do so.

If someone objects

If a caller asks not to be recorded, the product is built to stop the audio recording and to keep a written transcript of the rest of the call. You should still train your greeting and your staff for the rule that applies to you.
